What You Need to Know Before September 1, 2025
If you’re a fan of pre-filled CBD, Delta-8, HHC, or THCA vape cartridges, there’s a significant update you need to hear. Under SB 2024, the State of Texas is moving to ban all pre-filled hemp-derived vape products, including cartridges, starting September 1, 2025.
This law affects carts, disposable vapes, and any other pre-loaded device designed for inhalation of cannabinoids, even if they’re non-intoxicating and federally legal.
🚫 What’s Getting Banned?
Starting September 1, 2025, it will be illegal to sell, distribute, or possess the following in Texas:
- Pre-filled 510-thread vape carts
- Pre-filled pod systems (like JUUL-style or Pax-style hemp vapes)
- Disposable vape pens (all-in-one devices)
Whether the cart contains:
- CBD (even THC-free)
- Delta-8 or Delta-9 THC (under 0.3%)
- HHC, THCA, THCP
- CBG, CBN, or other cannabinoids
… it’s banned if it’s pre-filled and intended for use with a vaporizer.
✅ What Remains Legal?
You can still legally sell and use:
- Refillable vape devices, where you fill them yourself
- CBD tinctures, edibles, capsules, and topicals
- Hemp-derived Delta-9 edibles, under the federal 0.3% limit
- THC-free CBD oils and non-vape products
The key difference is that if it’s not pre-packaged for inhalation, it’s not covered by the ban.
🔍 Why Is This Happening?
Texas lawmakers say the ban is aimed at:
- Preventing underage access to vape products
- Reducing confusion between hemp and marijuana
- Addressing safety and health concerns from unregulated vape imports
Unfortunately, this law lumps safe, lab-tested, and legally compliant carts in with bad actors, impacting consumers, small businesses, veterans, and medical users who rely on inhalation as a delivery method.
🛒 What You Can Do Now
- Stock up on your favorite carts before the ban takes effect.
- Explore refillable options that enable the use of compliant products in open systems.
- Switch to tinctures, capsules, and edibles that deliver the same cannabinoids without the use of a vape.
- Support local shops working hard to stay compliant while continuing to serve your needs.
- Stay informed — a special legislative session is scheduled to begin on July 21, 2025, and future rules may be revised.
