Whether the cart contains:

  • CBD (even THC-free)
  • Delta-8 or Delta-9 THC (under 0.3%)
  • HHC, THCA, THCP
  • CBG, CBN, or other cannabinoids

… it’s banned if it’s pre-filled and intended for use with a vaporizer.

✅ What Remains Legal?

You can still legally sell and use:

  • Refillable vape devices, where you fill them yourself
  • CBD tinctures, edibles, capsules, and topicals
  • Hemp-derived Delta-9 edibles, under the federal 0.3% limit
  • THC-free CBD oils and non-vape products

The key difference is that if it’s not pre-packaged for inhalation, it’s not covered by the ban.

Texas lawmakers say the ban is aimed at:
