Over the weekend, the Texas House released an amendment to CS-SB3, claiming to “clarify” the definition of converted cannabinoids. On the surface, this may look like a softening of earlier language, but it’s far more dangerous. Behind the legalese is a direct threat to the entire Texas hemp industry.
What This Amendment Really Does
The amendment defines converted cannabinoids so broadly that it bans any hemp-derived product containing cannabinoids that have been altered in any way — even if those cannabinoids naturally occur in the hemp plant.
Products containing Delta-8, Delta-10, THC-O, HHC, THCP, and similar compounds are effectively outlawed. But here’s the catch: many of these compounds do occur naturally in hemp — just not in high enough quantities for commercial production without conversion.

Key Point: It’s Not About Safety — It’s About Control
Let’s be clear: Delta-8 THC is a naturally occurring cannabinoid in hemp. However, it only exists in trace amounts, so producers convert CBD into Delta-8 to create viable products. Under this amendment, even if the final product contains naturally occurring cannabinoids, conversion makes it illegal.
That means:
- Even a trace amount of converted cannabinoids is = an illegal product.
- Almost every hemp crop becomes non-compliant by default.
- The industry is banned, not regulated.
This Is a Full Ban Disguised as Regulation
This is not a measured compromise. It’s a coordinated effort to wipe out the hemp consumables market in Texas under the guise of responsible policymaking. The amendment doesn’t just target “synthetic” THC or isolate specific product categories — it casts a net so wide that it effectively bans the hemp plant itself when grown or used for consumables.
If this language becomes law, there will be no legal pathway for the hemp-derived products that have powered small businesses, farmers, and entrepreneurs across Texas.
This is the moment to speak up. Lawmakers must hear from the industry, consumers, and communities before this amendment quietly devastates an entirely legal and thriving marketplace.
